* 동성 결혼 혹은 파트너 십
현재 국내에는 동성혼 혹은 파트너십이 인정되지 않고 있으며 관련된 법, 제도는 전무한 실정입니다. 이성간 사실혼은 법률상 신고가 없을 뿐 국내에서도 실질적으로 파트너로서 공동생활관계를 유지, 영위한다는 점에서 보호하는 대상이 되고 있다. 그러나 동성 파트너에 대해서도 같은 논리로 충분히 법적 보장을 할 수 있을 텐데도 법원은 이를 인정하지 않고 있습니다. 그 예로 2004년 7월 인천지방법원은 동성 파트너 관계의 부당한 파기에 대한 재산분할 및 위자료 청구를 기각한바 있습니다.
