한 해가 또 저물어갑니다. 한 해의 마무리 작업이자 새로운 시작을 준비하는 장으로서의 인권보고대회를 목전에 두고 보고서를 펴냅니다. 인권보고대회는 그 해의 인권상황을 점검하고 다가올 한 해를 대비하는 의미를 가집니다. 해마다 해 오던 일이지만 이명박 정부 들어서 세 번째 작업을 하면서 유난히 착잡함을 금할 수 없습니다.
우리 모임이 이명박 정부 출범 후 발간했던 2008년도와 2009년도의 인권보고서를 되돌아봅니다. 2008년도 경제위기와 민주주의 후퇴에 기인한 인권상황의 악화에 이어 2009년에는 그 악화 정도가 심화되어 다음 해에 나아질 것이라는 섣부른 기대를 가지는 것조차 허용하지 않을 만큼 심각하다고 지적되어 있었습니다. 유감스럽게도 전년도의 이러한 지적이 2010년 말 현재 우리 인권현실이 되고 말았습니다. 올해는 그 악화정도가 실로 참담하다 못해 비탄하기까지 할 지경입니다.
한마디로 법치주의라는 용어가 무색한 한 해였습니다. 국가보안법 사건의 증가, 천안함 사건 관련 상반된 주장에 대한 국가보안법의 적용, 감청건수의 비약적 증가, 국정원 사찰을 폭로한 박원순 변호사에 대한 국가의 손해배상 청구소송 등 일일이 열거하기조차 힘든 많은 예에서 보이는 바와 같이 언론과 표현의 자유 및 집회·결사의 자유는 재갈 물린 상태에서 국가보안법을 다시 전면에 내세운 공권력 남용으로 점철되었습니다.
현 정부 들어 꾸준히 증대시켜 온 경찰력의 확대와 경찰권 행사를 강화하기 위한 법률개정 시도, 시국선언 교사 및 공무원들에 대한 기소, 피디수첩 제작진에 대한 기소와 무죄판결, 한명숙 전 총리에 대한 기소와 무죄판결, 천안함 사건의 의혹을 제기한 시민들에 대한 수사 엄포와 민간진상조사위원에 대한 기소, 총리실 민간인 사찰 사건 등은 과다한 공권력에 의존하여 국민들을 감시하고 통제하는 ‘경찰국가’로의 회귀를 보여주고 있습니다.
성접대 등 스폰서 검사들에 대한 불기소와 특검수사, 총리실 민간인 불법사찰에 대한 증거자료 은폐와 수사 축소, 그랜저 검사에 대한 무혐의 처분 등은 검찰개혁의 당위성을 확인해 주었습니다. 공권력 남용에 대한 브레이크 역할을 해야 할 헌법재판소나 사법부도 걸림돌 판결, 특히 국회 앞 집회금지 규정에 대한 합헌결정이나 소위 ‘불온서적 군법무관’ 관련 헌법소원 합헌결정과 파면처분취소사건에서의 패소판결 등에서 보듯이 제 소임을 다하지 못하였습니다. 국가인권위원회는 퇴락의 길을 걷고 말았습니다. 미완의 과거사 정리는 각종 과거사 관련 위원회의 존속기한 종료로 활동을 종료하고 말았습니다.
천안함 사건은 6․2 지방자치단체장 등과 교육감 선거에 악용되고 공안정국을 몰고 왔을 뿐 아니라 남북간 경제협력과 교류마저 단절시키고 남북관계를 군사적 긴장과 대결의 위기 국면으로 몰아갔습니다. 연평도 사건도 천안함 사건과 같은 배경에서 벌어진 일입니다. 한반도가 일촉즉발의 화약고가 되어 우리는 평화로운 생존권조차 위협받고 있는 실정입니다.
부동산거래 침체로 인한 전세 값의 폭등과 하우스푸어(house poor)의 대량양산에 대한 근본적인 대책의 미흡, 빈껍데기로 전락한 장애인 연금제도, 비정규법 시행에도 줄지 않은 비정규직과 이들의 상대적 임금감소 및 간접고용 확대, 공공부문의 비정규적 확대경향의 지속, 고용의 양극화와 질 저하의 심화, 여성․청년․노년․이주노동자 등에 대한 차별심화 등으로 서민들은 극심한 고통을 당하고 있습니다. 그런데 정부는 단기임시직만을 창출하는 일자리 창출사업으로 오히려 근로조건을 후퇴시키고 국가재정의 비효율적 사용을 초래하고 있습니다. 또한 4대강 사업으로 국고를 탕진하고 복지부분 예산의 감축을 초래하면서까지 환경파괴를 자행하고 있습니다.
산과 계곡이 깊을수록 물은 맑고, 밤이 깊을수록 새벽은 더 가까이 와 있습니다. 올 한 해 비참한 인권현실 와중에도 새벽이 곧 도래할 것이라는 희망의 씨앗을 볼 수 있는 예도 있었습니다. 천안함 사건 속에서 치러진 6․2 지방자치단체장 등과 교육감 선거에서 나타난 민의와 올해의 디딤돌 판결들이 그것입니다. 우리가 쟁취해야 할 자유, 평등, 평화의 폭과 깊이는 그저 주어지거나 우연의 산물이 아니라 피땀 어린 노력의 결과임을 상기하게 됩니다. 이러한 역사의 순리 앞에서 더욱 겸허하고 의연하게 우리의 길을 가야 함을 깨닫습니다. 그 길의 초입 단계에 지금의 상황과 우리의 노력을 엄밀하게 기록하고 평가하는 것이 놓여 있습니다. 2010년 현재의 인권현실을 뼈아프게 수용하되 곧 현재로 다가올 미래를 위한 냉정한 기록이자 우리들 자신에 대한 채찍질로서 그리고 희망 찾기의 일환으로서 이번 인권보고서를 펴냅니다.
제1부에서는 총괄보고와 함께 각 분야별 인권현황을 개관하는 한편, 제2부에서는 집중조명으로 천안함 사건을 둘러싼 제반 문제, 법치주의와 형사사법 문제, 4대강 사업의 법적 쟁점을 주제로 한 3개 분야를 살펴보았습니다. 제3부에서는 ‘2011년 한국인권운동의 방향’이라는 주제로 2011년을 진단하였는데, 이는 이번 대회가 종래 집중조명 주제별로 토론하던 방식과 달리 제3부 종합토론의 장을 마련한 데 대응하기 위한 발제에 해당합니다. 예년과 달리 결의문을 싣지 못한 것은 인권보고대회 결과를 종합하여 최종적으로 발제문을 수정보완해서 발간해 오던 인권보고서를 대회 전에 발제문 그대로 자료집으로 발간함에 기인하는 것입니다. ‘올해의 판결’은 금년부터 새로이 수록하는 것입니다. 이는 우리 모임의 각 위원회별로 해마다 선정해 왔으나 별도로 대외적 공표 없이 자체 자료축적만 해 오던 디딤돌과 걸림돌 판결을 전체적으로 취합하여 그 중 각 10개씩의 디딤돌과 걸림돌 판결로 선정한 것입니다.
이번 인권보고서를 내면서 전년도와 마찬가지로 올 한해의 인권상황이 다른 어느 해보다 악화되었음에도 뾰족한 해결책을 내놓지 못하는 점이 답답하고 애통합니다. 하지만, 이 보고서 내용에 대한 공감이 확산된다면 그 개선은 시간문제라고 믿습니다. 이 보고서가 인권에 관한 상식을 지닌 보통 사람들에게 많이 읽히고 좋은 기록으로 평가되기를 희망합니다.
