영국 의회의 상원은 155:57로 성별 인정 법안(Gender Recognition Bill)을 승인했다. 이는 영국의 트랜스젠더들에게 중요한 승리이다.
이제 이 법안은 하원에서 승인받아야 하는데, 그럴 경우 트랜스젠더들은 2005년부터 현재의 성별을 반영하는 새 출생 증명서를 발급받을 수 있게 된다. 이 증명서로 인해 트랜스젠더와 이성간의 결혼이 가능해진다.
이 법안에 의하면 새 출생 증명서 발급을 요구하는 개인은 자신이 잘못된 신체적 성별을 타고났다는 생각이 주요 특징인 성별 혼란(gender dysphoria) 진단을 받았다는 증명서를 제출해야 한다.
또한 트렌스젠더는 새 성별을 인정받기 위해서는 그 후 평생 동안 새 성별로 살아가겠다는 점을 증명해야 한다. 그러나 성별 정정(sex reassignment) 수술 자체를 반드시 받을 필요는 없다.
공식 기록상의 성별 정정은 엄격히 비밀에 붙여지나, 교회가 이같은 절차를 밟은 개인의 결혼식 거행을 거부할 수도 있다. 또한 체육 단체의 경우, 앞으로도 트랜스젠더 선수에 대한 특별 규정을 만들 수 있을 것이다.
현재 영국은 유럽 연합 회원국 중 트랜스젠더에게 출생 증명서상 성별을 공식적으로 변경하지 못하게 하는 극소수 국가에 속한다.
영국 상원은 다음달에 동성 결혼의 민법상 등록을 허용하는 또 다른 법안을 토의할 예정이다.
